These Terms govern your use of https://www.abhiraamgautham.com and your purchase or use of 7 Nights, BreathOS, articles, audio, video, assessments, live sessions and related services.
The website is operated by M. Gautam Gopiya, sole proprietor trading as Humming Nest, from No. 66, Fourth Cross, NKV Parkview, 17th Cross, MCECHS Layout, Bengaluru, Karnataka 560077, India. Abhiraam Gautham is the public-facing brand of this website. In these Terms, “we”, “us” and “our” refer to that operator. “You” refers to the visitor, purchaser or participant.
By completing an enrolment, you confirm that you have read and agreed to these Terms and the linked Privacy, Programme Delivery, Cancellation and Refund, and Wellness Disclaimer pages. If you do not agree, do not purchase or use the programme.
Eligibility
The paid programmes are intended for adults aged 18 or older. By purchasing, you confirm that you are at least 18 and legally able to enter into a contract. If a programme for minors is offered in the future, it will require separate safeguarding, parental consent and privacy arrangements.
Programme descriptions
We aim to describe each programme accurately. The relevant programme page and checkout summary identify the current price, format, included elements, delivery method and access period.
7 Nights is a seven-night guided wellness experience offered at USD 199. After successful payment, the participant completes an assessment and onboarding process.
BreathOS is a 60-day structured wellness programme offered at USD 1,299. It is designed by Abhiraam Gautham and includes eight live guided integration sessions led by a designated programme facilitator. The programme does not promise continuous access to Abhiraam and does not represent that the eight sessions are personally conducted by him.
Draft content, prototypes, social posts, archived offers and private demonstrations do not change what is included in a completed purchase.
The Night Manager™
The Night Manager™ is the nightly guided practice and recovery protocol used within 7 Nights and BreathOS. It is not Abhiraam Gautham’s personal title. Abhiraam Gautham may be described as the creator of The Night Manager™ and founder of the BreathOS system, subject to final trademark and ownership confirmation.
Enrolment and payment
Prices and currency are shown before payment. You are responsible for reviewing the full amount, programme and refund summary before confirming purchase. Taxes or card-provider conversion charges will be shown or applied as required by the payment flow and applicable law.
Approved online payments are processed through Razorpay’s secure payment pages, which open on Razorpay’s own website. We do not ask you to send full card details by email, telephone or messaging. A payment is complete only when Razorpay confirms success.
We may refuse or cancel an enrolment where payment is unauthorised, fraudulent, duplicated, legally restricted, or incompatible with programme safety or capacity. If we cancel after receiving cleared funds and no service has been delivered, we will return the relevant amount subject to applicable law.
Delivery and access
Delivery follows the Programme Delivery and Fulfilment Policy. You must provide accurate contact details, keep your access credentials secure, and tell us promptly if access fails.
Programme access is personal and may not be shared, copied, resold, broadcast or used to train another person unless we give written permission.
Live sessions and facilitators
Where a programme includes live sessions, we will communicate attendance instructions and applicable time zones. You are responsible for joining on time from a safe and private setting.
A designated programme facilitator may deliver the live integration sessions in BreathOS as part of the programme’s professional delivery system. Facilitator assignment may change for legitimate operational, safety or availability reasons, provided that the material programme is not reduced.
Session recording is prohibited unless every affected participant and the provider have given prior written consent. We will disclose any provider recording purpose, access, retention and consent before recording begins.
Your responsibilities
You agree to:
- provide accurate enrolment, safety and contact information
- use the programme only for personal, lawful purposes
- follow facilitator instructions and safety guidance
- stop an activity if you feel pain, severe discomfort, dizziness, panic or other concerning symptoms
- seek qualified medical or mental-health advice when appropriate
- respect the privacy, dignity and intellectual property of other participants
- avoid disruptive, abusive, discriminatory, threatening or unlawful conduct
- protect login, meeting and access links from unauthorised use
Wellness scope and safety
The programmes are educational wellness experiences. They do not provide medical diagnosis, medical treatment, psychotherapy, crisis intervention or emergency care. Participation does not create a doctor-patient, therapist-client or other licensed clinical relationship.
You are responsible for deciding, with qualified professional advice where needed, whether a programme is suitable for you. We may ask limited safety questions and may suggest a modification, pause or refusal where reasonably necessary for safety. A disclaimer does not remove any duty that the law does not allow us to exclude.
The Wellness and Medical Disclaimer forms part of these Terms.
No guaranteed outcomes
Individual experiences differ. We do not guarantee sleep, recovery, emotional, performance, business, relationship or health outcomes. Any examples or testimonials describe individual experiences and are not promises of typical results.
Intellectual property
Unless stated otherwise, the website, programme structure, text, audio, video, graphics, exercises, The Night Manager™ materials, BreathOS materials and other original content are owned by or licensed to M. Gautam Gopiya, sole proprietor trading as Humming Nest. All rights are reserved.
We grant a purchaser a limited, personal, non-exclusive, non-transferable, revocable licence to use purchased materials for their own participation during the stated access period.
You may not reproduce, modify, translate, distribute, sell, sublicense, publish, upload, publicly perform, teach from, create derivative commercial material from, scrape or use the materials to train an artificial-intelligence model without written permission.
Participant material and confidentiality
You retain ownership of personal responses, journals, voice notes and other original material you submit. You grant us only the permission reasonably necessary to deliver, administer, support and secure the programme, and for any additional purpose to which you separately agree.
We will not use a personal story, image, recording, name or testimonial in marketing without specific permission. Group participants must keep other participants’ disclosures confidential, although we cannot guarantee that every participant will comply.
Do not submit information about another person unless you have authority and a lawful reason to do so.
Acceptable use
You must not interfere with the website, attempt unauthorised access, upload malicious code, impersonate another person, evade payment, infringe rights, harvest contact details, disrupt a session, or use the service for unlawful or harmful conduct.
Third-party services
We may use payment, email, hosting, form, video, messaging and programme-platform providers. Their own terms may apply to your direct use of their service. We select providers with reasonable care but do not control an independent provider’s entire network or availability.
Suspension and termination
We may suspend access where reasonably necessary to investigate fraud, security threats, serious misconduct, unlawful use, repeated disruption, or a material breach of these Terms. Where appropriate, we will explain the reason and allow a reasonable opportunity to respond.
Termination does not remove payment, confidentiality, intellectual-property, privacy or dispute obligations that by their nature continue after access ends. Refund rights remain governed by the Cancellation and Refund Policy and applicable law.
Service availability and changes
We may perform maintenance, correct errors, improve content or make reasonable operational changes. We will not materially reduce a purchased programme without offering an appropriate remedy.
Events outside reasonable control may delay a session or service. These can include widespread network failure, platform outage, natural disaster, serious illness, government restriction, civil emergency or other force majeure. We will communicate material disruption and use reasonable efforts to resume or offer an alternative.
Disclaimers
To the maximum extent permitted by law, the website and programme are provided with reasonable care but without a promise that every feature will be uninterrupted, error-free or suitable for every individual purpose. Nothing in these Terms excludes a statutory guarantee, duty or remedy that cannot lawfully be excluded.
Liability
Nothing in these Terms limits liability for fraud, wilful misconduct, death or personal injury caused by negligence where such liability cannot be limited, breach of a non-waivable consumer right, or any other liability that applicable law does not permit us to exclude.
Nothing in these Terms excludes or limits any liability, right or remedy that cannot lawfully be excluded or limited. Mandatory consumer rights remain unaffected. No custom monetary liability cap or participant indemnity applies in this version of the Terms.
Complaints and disputes
Please use the Contact and Grievance page first so we can try to resolve a concern promptly. This does not prevent you from using a bank dispute process, consumer commission, data-protection authority, court or other remedy available under applicable law.
These Terms are governed by the laws of India. Subject to mandatory consumer rights and the jurisdiction required by applicable law, disputes may be brought before the competent courts in Bengaluru, Karnataka. This clause does not deprive a consumer of mandatory rights or a forum available under the law of the consumer’s location.
Changes to these Terms
We may update these Terms for legal, security or service reasons. The page will show the new date. A material change affecting an existing paid programme will be communicated through a reasonable channel and will not be applied retrospectively where prohibited by law.
General terms
If one provision is invalid, the remaining provisions continue to the extent possible. A delay in enforcing a term is not a permanent waiver. You may not transfer a programme enrolment without written consent. We may transfer the agreement as part of a legitimate business reorganisation if your rights are not reduced and applicable law is followed.
